These terms apply if you promote LandlordHub as one of our affiliates and earn commission for the customers you refer. They are a contract between you and Gary Callaway, a sole trader trading as LandlordHub ("we", "us").
In summary: we give you a personal link with its own commission terms. When someone signs up through it and keeps paying, you earn a share of what they pay. We pay you monthly through Stripe. You must promote LandlordHub honestly, say that you're paid for it, and follow marketing law.
1.1 The programme is by invitation. We decide who can join, and we may decline or remove anyone at our discretion.
1.2 You must be at least 18. If you join for a business, you confirm you have authority to accept these terms for it.
1.3 These terms apply alongside our Terms of Service and Privacy Notice. If they conflict, these terms apply to the affiliate programme.
1.4 This programme is separate from the Refer & Earn scheme for landlord customers, which gives free months rather than commission.
2.1 We issue each affiliate link with its own terms, which we send you when we create it. They set out:
2.2 A customer keeps the terms of the link they signed up through, even if we later change that link's terms for new sign-ups.
2.3 Links can only be used as issued. You may not change them to point elsewhere, or combine them with other codes or offers unless we agree.
3.1 A sign-up is credited to you when a new customer arrives through your link and creates a LandlordHub account within 60 days, on the same device and browser, having allowed referral tracking in our cookie settings. If they don't allow it, or use another device, we may not be able to credit you, and we aren't responsible for sign-ups we can't track.
3.2 Commission is earned on the subscription payments the customer actually makes to us, after any refunds, and excluding VAT if we become VAT-registered. The free trial and any free months don't count.
3.3 Both the commission period and the qualifying period start from the customer's first payment.
3.4 No commission is earned for:
3.5 If more than one affiliate could claim a customer, the last affiliate link used before sign-up gets the credit. Our records decide which link a customer is credited to.
3.6 If a payment you've already been paid commission on is later refunded or charged back, we may deduct that commission from future payouts.
4.1 We pay through Stripe. You must complete Stripe's payout set-up, which includes identity checks and your bank details. Stripe collects these directly under its own terms and privacy notice. We don't see your bank details.
4.2 We pay commission that has passed its qualifying period at the start of each month. If the total due is below our minimum payout (currently £10), it carries over to the next month.
4.3 We can't pay you until your Stripe set-up is complete. Commission waits until it is, for up to 12 months from when it became payable. After that, unpaid commission lapses.
4.4 Payouts are in pounds sterling. You are responsible for any fees your bank charges.
4.5 If you think a payout is wrong, tell us within 60 days of it. We'll check our records and correct any mistake.
5.1 You must make it clear that you're paid for promoting LandlordHub, wherever you promote it, for example with "#ad" or "affiliate link" near the link. This is required by the Advertising Standards Authority's CAP Code and consumer protection law.
5.2 Everything you say about LandlordHub must be accurate and not misleading. Only describe features and prices shown on our website at the time. Don't promise outcomes, such as that LandlordHub will make someone legally compliant.
5.3 You must follow the law on electronic marketing (the Privacy and Electronic Communications Regulations 2003). In particular, don't send marketing emails or texts to people who haven't agreed to receive them from you.
7.1 You are an independent affiliate, not our employee, worker, agent or partner. You can't make promises or contracts on our behalf.
7.2 Commission is paid without any deduction for tax or National Insurance. You are responsible for declaring it and paying any tax due, and for any VAT if you are VAT-registered.
8.1 We tell you how many sign-ups and payments are credited to your links and what commission is due. We don't give you customers' names or contact details, and you must not try to identify them.
8.2 If you collect personal data yourself while promoting LandlordHub (for example your own mailing list), you are the controller of it and responsible for complying with data protection law.
8.3 Our Privacy Notice explains how we use affiliates' personal data.
9.1 You may use the LandlordHub name, and any logos or images we give you, only to promote LandlordHub under these terms, and only as we supply them. You must stop using them when you leave the programme.
10.1 We may change these terms or the programme by telling you by email at least 14 days in advance. Changes don't affect commission already earned, or the terms for customers who have already signed up.
10.2 Either of us can end your participation at any time by email. We will pay commission already earned, and commission from customers who signed up before the end date for the rest of their commission period, unless we end it because you broke these terms.
10.3 If we reasonably believe you have broken these terms, we may suspend your links and payouts while we investigate, and withhold or reclaim commission connected with the breach.
10.4 We may end the whole programme on 30 days' notice. Section 10.2 will apply to commission already earned.
11.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited.
11.2 Otherwise, we aren't liable for loss of profit or indirect loss, and our total liability to you under these terms is limited to the commission paid or payable to you in the 12 months before the claim.
11.3 You are responsible for, and will cover our reasonable costs of, any claim or regulatory action caused by how you promoted LandlordHub in breach of these terms.
12.1 We may transfer these terms to a limited company set up to run LandlordHub, or to a buyer of the business, and will tell you if we do.
12.2 If any part of these terms is found invalid, the rest still applies. If we don't enforce a right straight away, we can still do so later.
12.3 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
12.4 Questions about the programme: [email protected], or by post to Gary Callaway trading as LandlordHub, Unit 173641, PO Box 7169, Poole, BH15 9EL.
